Whereas a draft of this Order has been laid before, and approved by, a resolution of each House of Parliament:

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 15(1) of the Scotland Act 1998(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:–

Citation and commencement

1.  This Order may be cited as the Scottish Parliament (Disqualification) Order 1999 and shall come into force on the day after the day on which it is made.

Specified Office-Holders

2.  An office-holder of a description specified in Part I of the Schedule to this Order is disqualified from being a member of the Scottish Parliament.

3.  An office-holder of a description specified in column 1 of Part II of the Schedule to this Order is disqualified from being a member of the Scottish Parliament for any constituency specified in relation to that office-holder in column 2 of that Schedule and for any region specified in relation to that office-holder in column 3 of that Schedule.

Explanatory Note

(This note is not part of the Order)

This Order specifies the office-holders who are disqualified from being a member of the Scottish Parliament. Part I of the Schedule specifies the office-holders which are disqualified from being a member of the Parliament and Part II of the Schedule specifies the office-holders which are disqualified from being a member of the Parliament but only for particular constituencies or regions.
