The Secretary of State for the Environment, Transport and the Regions, as respects England, and the Secretary of State for Wales, as respects Wales, being designated1 Ministers for the purposes of section 2(2) of the European Communities Act 19722 in relation to the prevention and limitation of the effects of accidents involving dangerous substances, in exercise of the powers conferred upon them by that section and by sections 5, 7(1), 11(2), 11(7), 17(2), and 40(1) of the Planning (Hazardous Substances) Act 19903, and of all other powers enabling them in that behalf, hereby make the following Regulations:–
