SEX DISCRIMINATION

The Epsom College (Modification) Order 1999

Whereas–

(1) the foundation known as Epsom College (“the College”) (formerly known as The Royal Medical Benevolent College) at Epsom in the County of Surrey is regulated by the Royal Medical Benevolent College Act 1855(1) (“the 1855 Act”), the Royal Medical Benevolent College Act 1894(2) (“the 1894 Act”) and by a Scheme made by the Charity Commissioners and the Board of Education and confirmed by the Epsom College Scheme Confirmation Act 1932(3), which together shall be referred to in this Order as “the relevant instruments”;

(2) the relevant instruments concern, amongst other matters, property which is applicable for or in connection with the provision of education in an establishment in paragraphs 1 to 5 of the Table in section 22 of the Sex Discrimination Act 1975(4);

(3) the benefits available under the relevant instruments relating to schools are restricted to boys;

(4) accordingly, the relevant instruments, in so far as they concern property applicable for or in connection with the provision of education in any establishment in paragraphs 1 to 5 of the Table in section 22 of the Sex Discrimination Act 1975, are instruments to which section 78 of the said Act of 1975 applies;

(5) the Council of the College, as the responsible body for the purposes of section 78(2) of the Sex Discrimination Act 1975, have applied to the Secretary of State for an Order under the said section 78 and have published notice of the proposed Order in accordance therewith;

(6) no representations were made to the Secretary of State within the period specified in the said notice, and

(7) the Secretary of State is satisfied that the removal of the restrictions hereinbefore referred to would conduce to the advancement of education without sex discrimination:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 78(2) of the Sex Discrimination Act 1975, hereby makes the following Order:

Title and commencement

1.  This Order may be cited as the Epsom College (Modification) Order 1999 and shall come into force on 23rd April 1999.

Modification

2.  In so far as the relevant instruments concern property applicable for or in connection with the provision of education in any establishment in paragraphs 1 to 5 of the Table in section 22 of the said Act of 1975, they shall have effect as if, in the 1855 Act and in the 1894 Act, there were substituted for the words “sons” and “boys” wherever they occur the word “children”.

Explanatory Note

(This note is not part of the Order)

This Order, made under section 78 of the Sex Discrimination Act 1975, modifies the Royal Medical Benevolent College Act 1855, the Royal Medical Benevolent College Act 1894 and the Epsom College Scheme Confirmation Act 1932. These Acts relate to the foundation which was known as the Royal Medical Benevolent College and which is now known as Epsom College. The effect of the modification is to allow girls, as well as boys, to be admitted to any school of the foundation.
