The Licensed Victuallers' National Homes (Charter Amendment) Order 2000

WHEREAS the Licensed Victuallers' National Homes (hereinafter referred to as “the charity”) was incorporated by Royal Charter dated 15th December 1842:

AND WHEREAS the charity was granted a Supplemental Charter on 11th November 1970 (“the Supplemental Charter”):

AND WHEREAS the Charity Commissioners for England and Wales, in exercise of their powers under section 15 of the Charities Act 19931, have made a Scheme dated 20th December 1999 for the purpose of extending the permitted application of the funds of the charity:

AND WHEREAS by virtue of section 15(1) of the said Act the said Scheme cannot come into operation unless or until Her Majesty thinks fit to amend the Supplemental Charter in such manner as will permit the Scheme to have effect:

AND WHEREAS the charity has accordingly made application to Her Majesty in Council for amendment of the Supplemental Charter:

NOW, THEREFORE, Her Majesty, in exercise of the powers contained in section 15(2) of the said Act, and all other powers enabling Her in that behalf, is pleased, by and with the advice of her Privy Council, to order, and it is hereby ordered, that the said Supplemental Charter be amended in the manner set forth in the Schedule to this Order.

This Order may be cited as the Licensed Victuallers' National Homes (Charter Amendment) Order 2000 and shall come into force on 1st June 2000.

SCHEDULEAMENDMENT TO THE SUPPLEMENTAL CHARTER OF THE LICENSED VICTUALLERS' NATIONAL HOMES

Rule 3 of the Supplemental Charter shall be deleted and replaced by the following rule:

The Society is established for charitable purposes only.

The principal objects of the Society are to provide, construct, improve, manage and maintain Homes and any associated amenities for and to contribute towards the maintenance of distressed or aged persons in need and their partners to mitigate the ills consequent on old age affecting such persons with priority being given to persons who have been licensed victuallers and thereafter to persons who have worked in breweries, distilleries and other industries providing goods and services to the licensed trade and thereafter to distressed or aged persons in need and others as aforesaid.

This Order amends the Charter of the Licensed Victuallers' National Homes (“the charity”) so as to give effect to a Scheme made by the Charity Commissioners for England and Wales extending the permitted application of the funds of the charity. The funds will now additionally benefit distressed or aged persons who have worked in breweries and distilleries and other distressed or aged persons in need, as well as (as before) distressed or aged former licensed victuallers to whom priority will be given.
