The Greater London Authority Act 1999 (Commencement No. 7, Transitional Provisions and Amendment) Order 2000

In exercise of the powers conferred upon him by sections 420 and 425 of the Greater London Authority Act 19991, the Secretary of State hereby makes the following Order:

Citation and interpretation1

This Order may be cited as the Greater London Authority Act 1999 (Commencement No. 7, Transitional Provisions and Amendment) Order 2000.

In this Order “the Act” means the Greater London Authority Act 1999; and “the Receiver” means the Receiver for the Metropolitan Police District.

Commencement2

The provisions of the Act specified in the first column of the Schedule shall come into force on 3rd July 2000, where applicable, to the extent specified or subject to the transitional provision made in the second column.

Amendment of earlier commencement order3

The Greater London Authority Act 1999 (Commencement No. 4 and Adaptation) Order 20002 shall be amended as follows.

In the second column of Part 3 of the Schedule, opposite the entry for Part IV Chapter XIV, before “in so far as not already in force”, there shall be inserted “with the exception of section 287(2)”.

Save in so far as sections 10 to 12 of the Metropolitan Police Act 1829 relate to the Receiver’s functions in relation to purposes other than police purposes, but subject to the following transitional provision:

In so far as accounts of monies for police purposes have not been made out and signed in relation to periods up to 2nd July 2000 pursuant to section 11 of the Metropolitan Police Act 1829 by 3rd July 2000, they shall be made out and signed after that date by the chief finance officer of the Metropolitan Police Authority3.

Where a complaint has been recorded before 3rd July 2000 about the conduct of a member of the metropolitan police force who is a senior officer within the meaning of section 65 of the Police Act 1996 and the complaint has not been dealt with at that date, the Commissioner of Police of the Metropolis shall continue to be the appropriate authority in relation to that complaint until it has been dealt with in accordance with Chapter 1 of Part IV of that Act.

Article 2 of this Order brings into force on 3rd July 2000 the provisions of the Greater London Authority Act 1999 which relate to the Metropolitan Police Authority and members of the metropolitan police force in so far as they are not already in force. It also brings into force various consequential amendments and repeals subject to the transitional provisions set out in the Schedule to the Order. Where amendments and repeals relate to the functions of the Receiver for the Metropolitan Police District, the provisions are commenced only in relation to his functions for police purposes.

Article 3 amends the Greater London Authority Act 1999 (Commencement No. 4 and Adaptation) Order 2000 so that section 287(2) which amends the definition of “London authority” in Part II (traffic in London) of the Road Traffic Act 1991, does not come into force on 3rd July 2000 as provided in that Order.
