The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, acting jointly in exercise of the powers conferred on them by that section insofar as these Regulations could not have been made under the powers mentioned below;
And the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly in exercise of the powers conferred on them by sections 16(1)(b), (c), (d) and (f), 17(1), 19(1), 26(2)(e) and (f), 37(2) and 48(1) of, and paragraphs 5(1) and (2)(a), 6(1) and 7(1) and (2) of Schedule 1 to, the Food Safety Act 1990(3), and of all other powers enabling them in that behalf, after consultation in accordance with section 48(4) of that Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations, and after consultation with the Council on Tribunals in accordance with section 8 of the Tribunals and Inquiries Act 1992(4);
Make the following Regulations:

1990 c. 16; “the Ministers” is defined in relation to England and Wales in section 4(1) of the Act. Functions of “the Ministers” so far as exercisable in relation to Wales were transferred to the National Assembly for Wales by S.I. 1999/672. Functions of “the Ministers” in relation to England were further modified by S.I. 1999/3141.
