The Utilities Act 2000 (Commencement No. 2) Order 2000

The Secretary of State, in exercise of the powers conferred on him by section 110(2) of the Utilities Act 2000(1), hereby makes the following Order:—

Citation

1.  This Order may be cited as the Utilities Act 2000 (Commencement No. 2) Order 2000.

Provisions of the Utilities Act 2000 commenced by this Order

2.  1st November 2000 is the appointed day for the coming into force of the provisions of the Utilities Act 2000 listed in the first column of the Schedule to this Order for the purposes set out in the second column.

Explanatory Note

(This note is not part of the Order)

This is the second Commencement Order made under the Utilities Act 2000 (“the Act”).

Article 2 brings into force on 1st November 2000 those provisions of the Act listed in the Schedule to the Order for the purposes specified therein. It brings into force those provisions of section 1 of the Act (section 1(1), (2) and (4)) which provide for the creation of the Gas and Electricity Markets Authority (“the Authority”) and for Schedule 1 to the Act (which relates to the establishment and functioning of the Authority) to take effect. Those provisions of section 2 (section 2(1), (2) and (4)) which provide for the creation of the Gas and Electricity Consumer Council (“the Council”) and certain paragraphs of Schedule 2 to the Act (which relates to the Council’s establishment and functioning) are also brought into force. Section 3(3) to (5) and (8) of, and Schedule 3 to the Act which relate to schemes for the transfer to the Authority and Council of property, rights and liabilities of the Director General of Gas Supply and Director General of Electricity Supply are also brought into force.

Further certain minor, consequential and transitional provisions are brought into force by article 2.
