The Secretary of State for Social Security, in exercise of the powers conferred by sections 83(1) and 85(6) of the Welfare Reform and Pensions Act 1999(1), which contains only regulations made by virtue of or consequential upon section 55(2) of that Act and which is made before the end of the period of 6 months beginning with the coming into force of that section 55(2)(2), hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Social Fund (Recovery by Deductions from Benefits) Amendment Regulations 2000 and shall come into force on 9th April 2001.

Amendment to regulation 3 of the Social Fund (Recovery by Deductions from Benefits) Regulations 1988

2.  In regulation 3 (benefits from which an award may be recovered) of the Social Fund (Recovery by Deductions from Benefits) Regulations 1988(3), after paragraph (dd)(4) there shall be inserted the following paragraphs—

(ee)widowed parent’s allowance under section 39A of the Social Security Contributions and Benefits Act 1992(5);

(ff)bereavement allowance under section 39B of the Social Security Contributions and Benefits Act 1992(5)..

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Social Fund (Recovery by Deductions from Benefits) Regulations 1988 (S.I. 1988/35). They prescribe widowed parent’s allowance and bereavement allowance as benefits from which awards from the social fund may be recovered by deduction.

These Regulations are made before the expiry of 6 months from the commencement of the provision in consequence of which they are made and are accordingly exempt under section 173(5)(b) of the Social Security Administration Act 1992 (c. 5) from reference to the Social Security Advisory Committee and have not been so referred.

These Regulations do not impose a charge on business.
