In exercise of the powers conferred by section 128(1), (2) and (6) of the Education Reform Act 1988(1) the Secretary of State for Education and Employment, after consultation with Bretton Hall higher education corporation(2) and the Higher Education Funding Council for England in accordance with subsection (4) of the said section 128 and with the consent of the University of Leeds given in accordance with subsection (2) of that section, hereby makes the following Order:—

1.—(1) This Order may be cited as the Bretton Hall Higher Education Corporation (Dissolution) Order 2001 and shall come into force on 1st August 2001.

(2) In this Order “the corporation” means Bretton Hall higher education corporation.

2.  On 1st August 2001 the corporation shall be dissolved and all of its property, rights and liabilities shall be transferred to and vest in the University of Leeds.

3.  Section 127 of the Education Reform Act 1988 shall apply to any person employed by the corporation immediately before 1st August 2001 as if the reference in that section—

(a)to a person to whom that section applies were to a person so employed;

(b)to the transfer date were to 1st August 2001;

(c)to the transferor authority were to the corporation; and

(d)to the corporation were to the University of Leeds.

Explanatory Note

(This note is not part of the Order)

This Order dissolves Bretton Hall higher education corporation. It provides that the property, rights and liabilities of the dissolved corporation transfer to the University of Leeds and secures the rights of employees by applying section 127 of the Education Reform Act 1988.
