The Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2001

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2001 and shall come into force on 17th May 2001, but shall have effect, where appropriate, from the dates specified in this Order.

(2) In this Order “the Act” means the Superannuation Act 1972.

Employments

2.  The following shall be included among the kinds of employment to which a scheme under Section 1 of the Act can apply:

(a)employment by the Human Fertilisation and Embryology Authority, with effect from 1st April 2000,

(b)employment by the Immigration Services Commissioner, with effect from 16th October 2000

and accordingly, Schedule 1 to the Act is amended by inserting at the appropriate place in the list of “Other Bodies”, the entries—

3.  The following offices shall be included among the offices to which a scheme under section I of the Act can apply:

(a)the Immigration Services Commissioner with effect from 22nd May 2000,

(b)the Deputy Immigration Services Commissioner with effect from 5th June 2000, and

(c)the First Civil Service Commissioner with effect from 1st August 2000

and accordingly Schedule 1 to the Act is amended by inserting at the appropriate place in the list of “Offices”, the entries—

4.  The following entries are hereby removed from Schedule 1 to the Act:

(a)in the list of “Other Bodies”, the entry—

Explanatory Note

(This note is not part of the Order)

1.  Section 1 of the Superannuation Act 1972 (the Act) (under which the Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme and the Civil Service Compensation Scheme have been made) applies to employment and offices listed in Schedule 1 to that Act. This Order adds the offices of the First Civil Service Commissioner and the Immigration Services Commissioner and Deputy Immigration Services Commissioner to those listed in that Schedule. The Order also adds employment by the Immigration Services Commissioner and the Human Fertilisation and Embryology Authority to those listed in that Schedule.

2.  The office of the Immigration Services Commissioner was established under section 83 of the Immigration and Asylum Act 1999 (c. 30). Schedule 5, paragraph 16 to that Act provides that the Secretary of State must appoint a person to act as Deputy Immigration Services Commissioner.

3.  The Human Fertilisation and Embryology Authority is a body corporate established by section 5 of the Human Fertilisation and Embryology Act 1990 (c. 37).

4.  Under the power conferred by section 1(5)(c) of the Act, the office of the Director of Passenger Rail Franchising and employment with the Education Transfer Council are removed from that schedule.

5.  Under the power conferred by section 1(8)(a) of the Act the Order takes effect from the dates specified in the Order.
