The Secretary of State, in exercise of the powers conferred upon him by section 7(1) and (2) of the Elections Act 2001(1), hereby makes the following Order:

1.—(1) This Order may be cited as the Elections Act 2001 (Supplemental Provisions) (No. 2) Order 2001 and shall come into force on 11th May 2001.

(2) This Order extends to England and Wales only.

2.  Section 16(1) of the Representation of the People Act 1985(2) (postponement of poll at parish or community council elections) shall be modified so as not to apply to any polls due to be held on 7th June 2001.

Explanatory Note

(This note is not part of the Order)

Section 1(1) of the Elections Act 2001 postponed the ordinary day of election for an ordinary local government election in England and Wales in 2001 from 3rd May 2001 to 7th June 2001. Section 16(1) of the Representation of the People Act 1985 requires that where the poll at a parliamentary general election falls on the same day as the ordinary day of election for local government elections, the poll at any parish or community council election which would otherwise be held on that day must be postponed for three weeks. This Order disapplies the provisions of section 16 following the announcement of the general election on 7th June 2001 in order to avoid a further three week postponement of such parish or community council elections.
