The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988(1) and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:
1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 3) Regulations 2001 and shall come into force on 1st August 2001.
2. The Road Vehicles (Construction and Use) Regulations 1986(2) shall be further amended in accordance with the following provisions of these Regulations.
3.—(1) Regulation 61A shall be amended by the insertion in the third column of the Table the entry specified below.
(2) In item 1, after the last entry there shall be inserted—

4. In Table I in Schedule 2, after item 80 there shall be inserted the following item—

5. In Schedule 7B, in paragraph 7 for sub-paragraph (b) there shall be substituted the following sub-paragraph—
“(b)“the emissions publication” is the publication entitled “In-Service Exhaust Emission Standards for Road Vehicles—Seventh Edition” (ISBN 0-9526457-6-9) published by the Department of the Environment, Transport and the Regions.”

These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986.
Regulation 3 adds a reference to a recent Directive 2001/1 into item 1 of the Table in regulation 61A.
Regulation 4 adds the Directive to the list of Community Directives specified in Schedule 2.
Regulation 5 amends the definition of “the emissions publication” in Schedule 7B so as to refer to the most recent (i.e. the seventh) edition of the publication entitled “In-Service Exhaust Emission Standards for Road Vehicles”. The publication specifies, with respect to vehicles with spark ignition engines, the maximum permitted carbon monoxide content of exhaust emissions at idling speed and the limits for the ratio of air to petrol vapour entering the combustion chamber, in relation to each of the vehicle models named in the publication.
