Amendment of the Crime (Sentences) Act 19973

The Crime (Sentences) Act 1997 shall have effect subject to the following provisions of this Article.

In Schedule 1 in paragraph 12 (restricted transfers from Northern Ireland to England and Wales) for sub-paragraph (2)(a) there shall be substituted—
a
sections 13(7) and 24 of the Prison Act (Northern Ireland) 1953, Articles 3 to 6 of the Treatment of Offenders (Northern Ireland) Order 1976, Articles 26 to 28 of the Criminal Justice (Northern Ireland) Order 1996 and Articles 6 to 9 of the Life Sentences (Northern Ireland) Order 2001 or, as the case may require, section 1 of the Northern Ireland (Remission of Sentences) Act 1995 shall apply to him in place of the corresponding provisions of the law of England and Wales;

In Schedule 1 in paragraph 13 (restricted transfers from Northern Ireland to Scotland)—
a
for sub-paragraph (2)(a) there shall be substituted—
a
sections 13(7) and 24 of the Prison Act (Northern Ireland) 1953, Articles 3 to 6 of the Treatment of Offenders (Northern Ireland) Order 1976, Articles 26 to 28 of the Criminal Justice (Northern Ireland) Order 1996 and Articles 6 to 9 of the Life Sentences (Northern Ireland) Order 2001 or, as the case may require, section 1 of the Northern Ireland (Remission of Sentences) Act 1995 shall apply to him in place of the corresponding provisions of the law of Scotland;
b
in sub-paragraph (5) after the word “1996” there shall be inserted the words “, the Life Sentences (Northern Ireland) Order 2001”.

In Schedule 2 paragraph 10 is hereby repealed.
