Whereas, pursuant to section 18(1) of the Agriculture Act 1986(1), the Minister of Agriculture, Fisheries and Food (“the Minister”) has by order designated areas in the Blackdown Hills, the Cotswold Hills, Dartmoor, the Essex Coast, the Shropshire Hills and the Upper Thames Tributaries as environmentally sensitive areas;

Now, therefore, the Minister, in exercise of the powers conferred on her by section 18(1) and (4)(d)(2) of the said Act, and of all other powers enabling her in that behalf, with the consent of the Treasury, hereby makes the following Order:

1.  This Order may be cited as the Environmentally Sensitive Areas (Stage IV) Designation (Amendment) Order 2001 and shall come into force on 15th October 2001.

2.  In this Order “the principal Order” means the Environmentally Sensitive Areas (Stage IV) Designation Order 2000(3).

Amendment of the principal OrderU.K.

3.—(1) Article 4(2) of the principal Order shall be amended by the substitution, for sub-paragraphs (a) and (b), of the following sub-paragraphs—

(a)item 12 in Part 3 of Schedule 1;

(b)item 13, 14 or 15 in Part 3 of Schedule 3; or

(c)item 10, 11 or 12 in Part 3 of Schedule 6..

(2) Part 3 of Schedule 1 to the principal Order shall be amended as follows—

(a)in item 8—

(i)by the substitution for the entry in column 1 of—

8.  Management of woodland to enhance its nature conservation and landscape value.; and

(ii)in column 2, by deleting the figure “20”;

(b)in item 9, by the substitution in column 2 of “£0.23” for the figure “£0.25”; and

(c)after item 11, by inserting in column 1—

12.  Hedge management.; and

(ii)in column 2, “£0.30 per metre”.

(3) Part 3 of Schedule 3 to the principal Order shall be amended as follows—

(a)in item 8—

(i)by the substitution for the entry in column 1 of—

8.  Management of woodland to enhance its nature conservation and landscape value.; and

(ii)in column 2, by deleting the figure “15”;

(b)in item 9, by the substitution in column 2 of “£0.23” for the figure “£0.25”; and

(c)by inserting after item 14—

(i)in column 1—

15.  Hedge management.; and

(ii)in column 2, the figure “£0.30 per metre”.

(4) Part 3 of Schedule 5 to the principal Order shall be amended as follows—

(a)in item 8—

(i)by the substitution for the entry in column 1 of—

8.  Management of woodland to enhance its nature conservation and landscape value.; and

(ii)in column 2, by deleting the figure “20”;

(b)in item 10(a), by the substitution in column 1, for “the period ending on 31st August 2001”, of the words “any period before 1st April 2001”; and

(c)in item 10(b), by the substitution in column 1, for “the period beginning after 31st August 2001”, of the words “any period beginning after 31st March 2001.”

(5) Part 3 of Schedule 6 to the principal Order shall be amended by inserting after item 11—

(i)in column 1—

12.  Hedge management.; and

(ii)in column 2, “£0.35 per metre”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Environmentally Sensitive Areas (Stage IV) Order 2000 (“the principal Order”) which designated areas in the Blackdown Hills, the Cotswold Hills, Dartmoor, the Essex Coast, the Shropshire Hills and the Upper Thames Tributaries as environmentally sensitive areas.

The Order amends, with effect from 15th October 2001, some of the rates of payments to be made by the Minister of Agriculture, Fisheries and Food, pursuant to a management agreement made under section 18(3) of the Agriculture Act 1986 and rectifies some errors contained in the principal Order (article 3).

No Regulatory Impact Assessment has been prepared in respect of this Order.
