The England Rural Development Programme (Project Variations) Regulations 2001

Coming into force
The Secretary of State, being a Minister designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the common agricultural policy of the European Community and measures relating to the promotion of rural development, in exercise of the powers conferred on her by the said section 2(2) and of all other powers enabling her in that behalf, hereby makes the following Regulations:
Title, commencement and extent1

These Regulations may be cited as the England Rural Development Programme (Project Variations) Regulations 2001 and shall come into force on 1st January 2002.

These regulations shall extend to England only.
Interpretation2
Amendment of the Energy Crops Regulations3

The Energy Crops Regulations shall be amended in accordance with the provisions of paragraph (2) of this regulation.

In regulation 5 (approval of projects), the following paragraph shall be substituted for the existing paragraph (6)—

Before varying an approval under paragraph (4), the Minister shall—
a
give the beneficiary notice in writing that he proposes to do so with a statement of his reasons;
b
give the beneficiary an opportunity to make written representations within such time as the Minister considers reasonable; and
c
consider any such representations.
Amendment of the Rural Enterprise Regulations4

The Rural Enterprise Regulations shall be amended in accordance with the provisions of paragraph (2) of this regulation.

In regulation 5 (approval of projects), the following paragraph shall be substituted for the existing paragraph (3)—

Before varying an approval under paragraph (2), the Minister shall—
a

The Vocational Training Regulations shall be amended in accordance with the provisions of paragraph (2) of this regulation.
