The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to noise emission in the environment by equipment for use outdoors, in exercise of the powers conferred on her by that section and of all her other enabling powers, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Noise Emission in the Environment by Equipment for use Outdoors (Amendment) Regulations 2001 and shall come into force on 3rd January 2002.

Amendments to the Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001

2.—(1) In regulation 3(2) of the Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001(3) after the words “as further defined in Schedule 4”, there shall be added “in respect of the requirements relating to the sound power level of equipment.”.

(2) In regulation 19(2) there shall be deleted the words “(1) or (2)”.

(3) In Schedule 13, paragraph 1(1) for the words “Department of the Environment, Transport and the Regions” there shall be substituted “Department of Transport, Local Government and the Regions”.

(4) In Schedule 13, paragraph 7(5), for the word “regulation” there shall be substituted “paragraph”.

Explanatory Note

(This note does not form part of the Regulations)

These Regulations amend the Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001(S.I. 2001 No. 1701) (“the principal Regulations”). Regulation 3(2) of the principal Regulations providing for the exclusion of a provision in the Supply of Machinery (Safety) Regulations 1992 (S.I. 1992 No. 3073) is amended; two cross-references in the principal Regulations are amended.

A full Regulatory Impact Assessment (RIA) was undertaken for S.I. 2001 No. 1701. The Amendment Regulations have no effect on this RIA, which therefore remains unchanged. A copy of the RIA can be found at the following website address: www.dti.gov.uk/access/ria/emission regs 2001.htm

The Noise Emission in the Environment by the Equipment for use Outdoor Regulations 2001 implement the European Parliament and the Council Directive 2000/14/EC on the approximation of the laws of the Member States relating to the noise emission in the environment by equipment for use outdoors. These Regulations make only minor corrections to those Regulations, so a Transposition Note has not been prepared for this instrument.
