The Criminal Justice and Court Services Act 2000 (Commencement No. 3) Order 2001

In exercise of the powers conferred on the Secretary of State by section 80 of the Criminal Justice and Court Services Act 2000(1), the Secretary of State for Education and Employment hereby makes the following Order:

1.  This Order may be cited as the Criminal Justice and Court Services Act 2000 (Commencement No. 3) Order 2001.

2.  Section 72 of the Criminal Justice and Court Services Act 2000 (failing to secure regular attendance at school) shall come into force on 1st March 2001.

Explanatory Note

(This note is not part of the Order)

This Order brings into force section 72 of the Criminal Justice and Court Services Act 2000 on 1st March 2001. Section 72 amends section 444 of the Education Act 1996 (c. 56) to include an aggravated offence where a parent, knowing that his child is failing to attend regularly at school, fails without reasonable justification to cause him to attend. A person guilty of such an offence is liable on summary conviction to a fine not exceeding level 4 on the standard scale or to imprisonment for a term not exceeding three months.
