PART IPRELIMINARY

Title, commencement and extent1

These Regulations may be cited as the Access to the Countryside (Provisional and Conclusive Maps) (England) Regulations 2002 and shall come into force on 29th July 2002.

These Regulations extend to England only3.

General interpretation2

In these Regulations, unless the context otherwise requires—

  • “the Act” means the Countryside and Rights of Way Act 2000;

  • “the Agency” means the Countryside Agency;

  • “conclusive map” means a map issued by the Agency in conclusive form under section 9;

  • “draft map” means a map prepared by the Agency under section 4 and issued by the Agency in draft form under section 5;

  • “parish council” has the same meaning as in Part I of the Local Government Act 19724;

  • “proper officer” shall be construed in accordance with section 270(3) of the Local Government Act 1972;

  • “provisional map” means a map issued by the Agency in provisional form under section 5(d) or (e);

  • “reduced scale map” means, in relation to a provisional or conclusive map, a copy of that map in printed or electronic form which may be on a smaller scale than the scale of the provisional or conclusive map (or any part of it) but—

    1. a

      for the purposes of regulation 12, must be on a scale of not less than 1/10,000, and

    2. b

      for all other purposes, must be on a scale of not less than 1/25,000; and

  • “review conclusive map” means a conclusive map issued by the Agency on a review under section 10.

In these Regulations—

a

references to a period during which a provisional map remains current are references to the period which ends on the date on which the Agency have issued—

i

a conclusive map covering the area of land to which the provisional map relates, or

ii

a draft map covering that area, which the Agency have prepared in accordance with a requirement imposed on them under section 6(4)(b),

or, where maps are issued covering particular parts of that area, to the period which ends on the date on which the Agency have issued the last in a succession of such maps issued by them which together (in any combination of conclusive or draft maps) cover the whole of that area;

b

references to a period during which a conclusive map remains current are references to the period which ends on the date on which the Agency have issued a review conclusive map covering the area of land to which the conclusive map relates or, where review conclusive maps are issued covering particular parts of that area, to the period which ends on the date on which the Agency have issued the last in a succession of such maps issued by them which together cover the whole of that area;

references to a period during which a reduced scale map remains current are references to the period during which the provisional or conclusive map from which it is derived remains current; and

d

references to sections are references to sections of the Act and references to a Part are to the relevant Part of these Regulations.
