Coming into force in accordance with article 1
1. This Instrument may be cited as The Wiltshire County Council (Semington Aqueduct) Scheme 2000 Confirmation Instrument 2002 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
2. The Wiltshire County Council (Semington Aqueduct) Scheme 2000 (“the Scheme”) is hereby confirmed with modifications.
3. The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Department for Transport, Local Government and the Regions, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of Wiltshire County Council, County Hall, Bythesea Road, Trowbridge, Wiltshire BA14 8JN.

The Wiltshire County Council (hereinafter referred to as “the Council”) make this Scheme in exercise of their powers under sections 106(3) and 108(4) of the Highways Act 1980 and of all other powers enabling them in that behalf.
1. The Council are authorised to construct an aqueduct, to take the navigable waters of the Kennet and Avon Canal over the new road, specified in Part 1 of the Schedule to this Scheme in connection with the highway which they are proposing to construct between Semington and Melksham in the District of West Wiltshire in the said County.
2. The Council are also authorised in connection with the construction of that aqueduct to divert temporarily the length of the navigable watercouse specified in Part 2 of the said Schedule in the manner shown in that part of the Schedule.
3. This Scheme may be cited as the Wiltshire County Council (Semington Aqueduct) Scheme 2000.
The location and general design of the Aqueduct are shown on the plan numbered 42348/0504A attached hereto.
From a point on the north bank of the Kennet & Avon Canal, 476 metres east of the A350 to a point on the south bank of the Kennet & Avon Canal, 510 metres east of the A350.
An aqueduct of two spans of 13.4 metres each over the new road.
Two channels of 5 metre clear waterway.
The Aqueduct will have two channels of 5 metres with a 3,500 mm towpath and a 3,500 mm maintenance access path on either side. There will be 5.5 metres minimum headroom over the proposed A350 Semington—Melksham Diversion.
1. The temporary diversion of the Kennet & Avon Canal from a point 390 metres east of the A350 to a point 610 metres east of the A350.
2. The above works are to enable the Semington Aqueduct to be constructed to carry the Kennet & Avon Canal over the proposed A350 Semington—Melksham Diversion.
3. The temporary canal diversion is shown on drawing number 42348/0505 attached hereto.
4. The Authority responsible for the navigable waterway is the British Waterways Board, Willow Grange, Church Road, Watford, Herts. WD17 4QA.
