The Education (Student Support)(Amendment)(No. 2) Regulations 2002

The Secretary of State for Education and Skills, in exercise of the powers conferred on the Secretary of State by sections 22, 42(6) and 43(1) of the Teaching and Higher Education Act 19981, hereby makes the following Regulations:—

Citation and commencement

1.

These Regulations may be cited as the Education (Student Support) (Amendment) (No. 2) Regulations 2002 and shall come into force on 1st September 2002.

The Education (Student Support) Regulations 20022 shall be amended in accordance with these Regulations.

Amendments to the Regulations

(1)

Regulation 12 shall be amended as follows.

For paragraph (3)(e)(i) substitute—

“(i)

a Health Authority or a Strategic Health Authority established pursuant to section 8 of the National Health Service Act 19773 or a Special Health Authority established pursuant to section 11 of that Act4;”

In regulation 20(12) after “regulation 12(2)(a)” insert “or 2 (b)”.

These Regulations amend the Education (Student Support) Regulations 2002.

The amendment to regulation 12(3)(e)(i) refers to the new Health Authorities and Strategic Health Authorities established under the National Health Service Reform and Health Care Professions Act 2002.

The amendment to regulation 20(12) provides that students undertaking courses leading to a qualification in a healthcare profession (other than a medical doctor or dentist) who are entitled to means tested benefits under sections 73(f) and 74(1) of the Education (Scotland) Act 1980 shall not be eligible for grants for living costs under regulation 12.
