The Employment Act 2002 (Commencement No. 2) Order 2002

The Secretary of State for Work and Pensions, in exercise of the powers conferred by section 55(2) of the Employment Act 2002(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Employment Act 2002 (Commencement No. 2) Order 2002.

(2) In this Order, any reference to a numbered section or Schedule is a reference to the section or Schedule bearing that number in the Employment Act 2002.

Appointed day

2.  The day appointed for the coming into force of—

(a)section 50 and Schedule 6 (use of information for, or relating to, employment and training);

(b)paragraphs 8, 16 and 17 of Schedule 7 and section 53 so far as it relates to those paragraphs;

(c)section 54 and Part (1) of Schedule 8 to the extent that they repeal the provisions specified in the Schedule to this Order;

(d)section 54 and Part (2) of Schedule 8 to the extent that they revoke paragraph 7 of Schedule 1 to the Social Security Administration (Fraud) (Northern Ireland) Order 1997(2),

shall be 9th September 2002.

Explanatory Note

(This note is not part of the Order)

This Order brings into force further provisions of the Employment Act 2002 (c. 22).

Section 50 and Schedule 6 (use of information for, or relating to, employment and training) as well as other provisions which are consequential on the coming into force of that section and Schedule, are brought fully into force on 9th September 2002. These provisions allow the Department for Work and Pensions to have supplied to them, and to use, information relating to a person’s employment and training. They also allow the Department to have access to tax information held by the Inland Revenue and Customs and Excise for the purpose of preventing fraud, both by those contracted to deliver employment and training programmes and by participants in those programmes.

Paragraph 50 of Schedule 7 to the Employment Act 2002 and Section 53 of that Act so far as it relates to that paragraph, was brought into force on 31st July 2002 by S.I.2002/1989. (C.62)
