EDUCATION, ENGLAND

These Regulations prescribe limits on the powers of head teachers to exclude pupils from school under s.52 of the Education Act 2002, and the procedure which is to be followed by the head teacher, the school governing body and the local education authority following an exclusion from a maintained school.

In exercise of the powers conferred on the Secretary of State by sections 52(3) and (4), 210(7) and 214 of the Education Act 20021, and after consultation with the Council on Tribunals in accordance with section 8 of the Tribunals and Inquiries Act 19922, the Secretary of State for Education and Skills hereby makes the following Regulations:
