In exercise of the powers conferred on the Secretary of State by sections 19 and 54(3) of the Education Act 1997(1), the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (School Performance Targets) (England) (Amendment) Regulations 2002 and shall come into force on 30th April 2002.

Amendment

2.  The Education (School Performance Targets) (England) Regulations 1998 shall be amended in accordance with regulations 3 and 4 of these Regulations.

3.—(1) Regulation 3 (targets for pupils in the second key stage) shall be amended as follows.

(2) In paragraph (2) after “subject to” there shall be inserted “paragraph (3A) and”.

(3) In paragraph (3) after sub-paragraph (b) there shall be inserted before the full stop—

(4) After paragraph (3) there shall be inserted—

(3A) In relation to the targets specified in sub-paragraphs (3)(c) and (d) above, and subject to paragraph (5), for the 2001-02 school year the reference in paragraph (2) to 31st December shall be treated as a reference to 31st July..

(5) In paragraph (5), after “designated school,” there shall be inserted “paragraph (3A) shall not apply and”.

4.—(1) Regulation 6 (publication of performance information) shall be amended as follows.

(2) After paragraph (2A) there shall be inserted—

(2B) Paragraph (1) shall not require the governing body to publish information relating to the performance targets specified in regulation 3(3)(c) and (d) in the school year 2001-02 if the school’s annual report for that year has already been published before the governing body have set those targets..

(3) In paragraph (5) after sub-paragraph (a)(ii) there shall be inserted—

(iii)the percentage of registered pupils at or near the end of the final year of the second key stage who achieved level 5 or above in NC tests in English; and

(iv)the percentage of registered pupils at or near the end of the final year of the second key stage who achieved level 5 or above in NC tests in mathematics; and.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (School Performance Targets) (England) Regulations 1998 so as to require additional performance targets to be set by schools for pupils in the final year of the second key stage. The additional targets relate to the percentage of such pupils achieving level 5 or above in NC tests in English and mathematics. Publication of the percentages of pupils achieving this level will be required as part of a school’s annual report. Consequential and transitional provisions maintain the existing modification to the statutory timetable for designated schools and provide that other schools are to have set the new targets for the school year 2002-03 by 31st July 2002.
