4.—(1) Regulation 6 (publication of performance information) shall be amended as follows.
(2) After paragraph (2A) there shall be inserted—
“(2B) Paragraph (1) shall not require the governing body to publish information relating to the performance targets specified in regulation 3(3)(c) and (d) in the school year 2001-02 if the school’s annual report for that year has already been published before the governing body have set those targets.”.
(3) In paragraph (5) after sub-paragraph (a)(ii) there shall be inserted—
“(iii)the percentage of registered pupils at or near the end of the final year of the second key stage who achieved level 5 or above in NC tests in English; and
(iv)the percentage of registered pupils at or near the end of the final year of the second key stage who achieved level 5 or above in NC tests in mathematics; and”.
