Amendments to the Magistrates' Courts Rules 198117

In rule 17(1)—

a

for “section 37 or 38 of the Act of 1980, section 56(1) of the Criminal Justice Act 1967, section 24(2)(a) of the Powers of Criminal Courts Act 1973, section 6 of the Bail Act 1976 or section 40(3)(b) of the Criminal Justice Act 1991” substitute “sections 3, 6, 116(3)(b) or 120(2)(a) of the Act of 2000 or section 6 of the Bail Act 1976”;

b

in sub-paragraph (g) for “section 28 of the Theft Act 1968 (orders for restitution)” substitute “section 148 of the Act of 2000 (restitution orders)”; and

c

omit sub-paragraph (h).

For rule 17(2) substitute—

Where a magistrates' court commits an offender to the Crown Court under the Vagrancy Act 1824 or sections 3, 6 or 120(2) of the Act of 2000 and the magistrates' court on that occasion imposes, under section 26 of the Road Traffic Offenders Act 19887, an interim disqualification for holding or obtaining a licence under Part III of the Road Traffic Act 1988, the justices' chief executive for the magistrates' court shall give notice of the interim disqualification to the appropriate officer of the Crown Court.
