Notice of unregistered interests89

If the registrar enters a notice of an unregistered interest under section 37(1) of the Act, he must give notice—

a

subject to paragraph (2), to the registered proprietor, and

b

subject to paragraph (3), to any person who appears to the registrar to be entitled to the interest protected by the notice or whom the registrar otherwise considers appropriate.

The registrar is not obliged to give notice to a registered proprietor under paragraph (1)(a) who applies for entry of the notice or otherwise consents to an application to enter the notice.

The registrar is not obliged to give notice to a person referred to in paragraph (1)(b) if—

a

that person applied for the entry of the notice or consented to the entry of the notice, or

b

that person's name and his address for service under rule 198 are not set out in the individual register in which the notice is entered.
