EMPLOYMENT AND TRAINING;RELIGION OR BELIEF DISCRIMINATION

These Regulations, which are made under section 2(2) of the European Communities Act 1972 (c. 68), implement (in Great Britain) Council Directive 2000/78/EC of 27th November 2000 establishing a general framework for equal treatment in employment (OJ L 303, 2.12.2000, p.16) so far as it relates to discrimination on grounds of religion or belief. The Regulations make it unlawful to discriminate on grounds of religion or belief in employment and vocational training. They prohibit direct discrimination, indirect discrimination, victimisation and harassment.

PART VISUPPLEMENTAL

Application to House of Commons staff37

These Regulations apply to an act done by an employer of a relevant member of the House of Commons staff, and to service as such a member, as they apply to an act done by and to service for purposes of a Minister of the Crown or government department, and accordingly apply as if references to a contract of employment included references to the terms of service of such a member.

In this regulation “relevant member of the House of Commons staff” means any person—

a

who was appointed by the House of Commons Commission; or

b

who is a member of the Speaker’s personal staff,

and subsections (6) to (12) of section 195 of the Employment Rights Act 1996 M1 (person to be treated as employer of House of Commons staff) apply, with any necessary modifications, for the purposes of these Regulations.
