The Secretary of State for Health, in exercise of the powers conferred upon him by sections 11(1), (2) and (4) and 126(3) of the National Health Service Act 19771, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement, application and interpretation1

This Order may be cited as the National Treatment Agency (Establishment and Constitution) Amendment Order 2003 and shall come into force on 12th August 2003.

This Order applies to England only.

In this Order “the Order” means the National Treatment Agency (Establishment and Constitution) Order 20012.

Amendment of article 4 of the Order2

Article 4 of the Order (constitution of the Agency) is amended as follows.

In paragraph (b), for “not less than 3 and not more than 8 members” there is substituted “not less than 3 and not more than 12 members”; and

In paragraph (d), for “not less than 2 and not more than 3 members” there is substituted “not less than 2 and not more than 4 members”.

This Order changes the constitution of the National Treatment Agency (“the Agency”), a Special Health Authority established under section 11 of the National Health Service Act 1977. The Agency is to have between 3 and 12 non-officer members rather than between 3 and 8, and between 2 and 4 officer members rather than between 2 and 3.
