Explanatory Note

(This note is not part of the Order)

This Order brings into force on 1st August 2003 section 7(2) of the Sexual Offences (Amendment) Act 2000 to the extent, if any, that it is not already in force. Section 7(2) provides that, for the purposes of the Scotland Act 1998, the Sexual Offences Amendment Act is to be taken to be a pre-commencement enactment.

The Order is intended to address the doubts expressed by the Subordinate Legislation Committee of the Scottish Parliament, when considering the Sexual Offences (Amendment) Act 2000 (Commencement No. 2) (Scotland) Order 2000 (SSI 2000/452), as to whether section 7(2) had been brought into force.
