The First Secretary of State, in exercise of the powers conferred upon him by section 31B of the Landlord and Tenant Act 19851 and section 24B of the Landlord and Tenant Act 19872, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Leasehold Valuation Tribunals (Fees) (Revocation and Saving) (England) Order 2003 and shall come into force on 30th September 2003.

Revocation and saving2

Subject to paragraph (2), the Leasehold Valuation Tribunals (Fees) Order 19973 is hereby revoked in relation to England.

The revocation in paragraph (1) shall not have effect in relation to any application made, or proceedings transferred by a county court, to a leasehold valuation tribunal before 30th September 2003 in respect of premises in England.

This Order revokes the Leasehold Valuation Tribunals (Fees) Order 1997 (“the 1997 Order”) except in so far as it has effect in relation to Wales.

The 1997 Order prescribes the fees payable for proceedings before a leasehold valuation tribunal, subject to reductions and exemptions.

The 1997 Order continues to apply to any application made, or proceedings transferred by a county court to, a leasehold valuation tribunal before 30th September 2003.

The Leasehold Valuation Tribunals (Fees) (England) Regulations 2003 (S.I. 2003/2098) prescribe the fees payable for proceedings before a leasehold valuation tribunal in respect of premises in England, where the application is made, or proceedings transferred, on or after 30th September 2003.
