The Adoption Agencies (Amendment) Regulations 2003

Coming into force

The Secretary of State, in the exercise of the powers conferred on him by section 9(2) and (3) of the Adoption Act 19761 hereby makes the following Regulations:—

Citation, commencement and application1

These Regulations may be cited as the Adoption Agencies (Amendment) Regulations 2003 and shall come into force on 27th October 2003.

These Regulations apply to England only.

Amendment of regulation 5A of the Adoption Agencies Regulations 19832

In regulation 5A of the Adoption Agencies Regulations 19832 (tenure of office of members), after paragraph (1), there is inserted —

Where —

a

a member of an adoption panel holds office and is in his second consecutive term as a member of that panel; and

b

his term of office is due to expire on or after 31st October 2003,

the adoption agency may extend the term of office of that member for a further period not exceeding two years.

These Regulations amend the Adoption Agencies Regulations 1983 (“the 1983 Regulations”) and apply to England only.

Regulation 2 amends regulation 5A of the 1983 Regulations to provide that an adoption agency may extend the term of office of a member of an adoption panel whose term of office is his second consecutive term of office and is due to expire on or after 31st October 2003 for a further period of two years.
