(1)

No person shall place on the market a plant protection product unless the packaging of that product satisfies the following requirements—

(a)

the packaging must be so designed and constructed that its contents cannot escape (unless special safety devices have been prescribed);

(b)

the materials constituting the packaging and fastenings must not be susceptible to attack by the contents, or liable to form harmful or dangerous compounds with the contents;

(c)

the packaging and fastenings must be strong and solid throughout so as to ensure that they will not come apart and will safely withstand normal handling;

(d)

containers with fastening devices must be so designed that the container can be repeatedly refastened so that the contents cannot escape.

(2)

Any person who contravenes or causes or permits any person to contravene paragraph (1) above shall be guilty of an offence.
