The Secretary of State, in exercise of the powers conferred upon him by sections 512(3) and 568 of the Education Act 1996(1) hereby makes the following Order:
1.—(1) This Order may be cited as the Education (School Lunches) (Prescribed Requirements) (England) Order 2003 and shall come into force on 6th April 2003.
(2) This Order applies in relation to England.
2. In this Order –
“lunch period” means the period between the morning and afternoon sessions on a school day;
“nursery education” means full-time or part-time education suitable for children who have not attained compulsory school age; and
“the 1996 Act” means the Education Act 1996.
3.—(1) The following requirements are prescribed for the purpose of section 512(3)(a) of the 1996 Act.
(2) A registered pupil who is receiving nursery education must be receiving full-time education or must be receiving education both before and after the lunch period.

This Order prescribes requirements for the purposes of section 512(3)(a) of the Education Act 1996.
The requirements only apply to registered pupils receiving nursery education; they must be either receiving full-time education, or be attending school for a period which spans the lunch break.
1996 c. 56; section 512 was substituted by section 201 of the Education Act 2002 (c. 32). By virtue of s.211 of that Act the powers conferred by s.512(3) of the 1996 Act are exercised only in relation to England.
