39. Section 2(1) of the Civil Evidence Act 1995(1) (duty to give notice of intention to rely on hearsay evidence) does not apply to evidence in restraint proceedings and receivership proceedings.
1995 c. 38. Sections 2 to 4 of the Civil Evidence Act 1995 apply to restraint proceedings by virtue of section 46 of the Proceeds of Crime Act 2002 (c. 29).
