The Secretary of State for Transport, in exercise of the powers conferred by sections 54 and 61 of the Road Traffic Act 1988(1) and of all other powers enabling him in that behalf, and after consultation in accordance with section 195(2) of that Act, hereby makes the following Regulations:
1. These Regulations may be cited as the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) Regulations 2003 and shall come into force on 31st March 2003.

2. In the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982(2), in regulation 4 (application of type approval requirements) after paragraph (14) there shall be inserted—
“(15) A vehicle or vehicle part shall be regarded as complying with the type approval requirements prescribed by paragraph (1)(b) if in relation to each applicable subject matter mentioned in Part I of Schedule 1 there is produced to the Secretary of State evidence which satisfies him that the vehicle or part, as appropriate, has been found by a competent authority in another EEA State to comply with requirements applicable to the vehicle or part, as appropriate, which are equivalent to those prescribed in relation to the subject matter.”.

These Regulations amend the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 so as to provide that if a vehicle or vehicle part has been found by a competent authority in another EEA State to comply with requirements equivalent to the type approval requirements prescribed by the principal Regulations it is to be regarded as complying with those prescribed requirements.
