The Secretary of State for Health, in exercise of the powers conferred by sections 10(1), (2) and (3A), 12(1) and (2) and 24(1) of, and paragraphs 1, 2, 4 and 13 of Schedule 3 to, the Superannuation Act 1972(1) and of all other powers enabling him in that behalf, after consulting such representatives of persons likely to be affected by these Regulations as appear to him to be appropriate(2) and with the consent of the Treasury(3), hereby makes the following Regulations:

1972 c. 11. Section 10(1) was amended by Schedule 5 to the National Health Service Reorganisation Act 1973 (c. 32) and section 4(2) of the Pensions (Miscellaneous Provisions) Act 1990 (c. 7). These powers are extended by section 42 of the Welfare Reform and Pensions Act 1999 (c. 30). Section 10(3A) was inserted by the Pensions (Miscellaneous Provisions) Act 1990, section 4(2). Section 24 was amended by section 13(1) of, and paragraph 10 of Schedule 2 to, the Police Pensions Act 1976 (c. 35).
