The Queen’s Most Excellent Majesty in Council
Whereas Her Majesty is satisfied that arrangements have been made in the States of Colorado, Georgia, Idaho, Illinois, Michigan, New Mexico, Ohio and Tennessee (the specified States) to ensure that maintenance orders made by courts in the United Kingdom can be enforced there:
And whereas Her Majesty is satisfied that in the interests of reciprocity it is desirable to ensure that maintenance orders made by courts in the specified States can be enforced in the United Kingdom:
Now, therefore Her Majesty, in exercise of the powers conferred by sections 40 and 45(1) of the Maintenance Orders (Reciprocal Enforcement) Act 1972(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1. This Order may be cited as the Reciprocal Enforcement of Maintenance Orders (United States of America) (Variation) Order 2003 and shall come into force on 15th May 2003.
2. Schedule 1 to the Reciprocal Enforcement of Maintenance Orders (United States of America) Order 1995(2) shall be varied by inserting between the words:—
(a)“California” and “Connecticut”, the word “Colorado”;
(b)“Florida” and “Indiana”, the words “Georgia, Idaho and Illinois”;
(c)“Massachusetts” and “Minnesota”, the word “Michigan”;
(d)“New Jersey” and “New York”, the words “New Mexico”;
(e)“North Dakota” and “Oklahoma”, the word “Ohio”;
(f)“South Dakota” and “Texas” , the word “Tennessee”.

The Reciprocal Enforcement of Maintenance Orders (United States of America) Order 1995 applies the provisions of Part I of the Maintenance Orders (Reciprocal Enforcement) Act 1972, as amended, to the States of the United States of America specified in Schedule 1 to that Order. This Order varies Schedule 1 to the 1995 Order by adding Colorado, Georgia, Idaho, Illinois, Michigan, New Mexico, Ohio and Tennessee to the list of specified States.
1972 c. 18: section 40 was amended by the Civil Jurisdiction and Judgments Act 1982 (c. 27), Schedules 11 and 14.
