The Secretary of State for Transport, in exercise of the powers conferred by section 302(1) of the Merchant Shipping Act 1995(1), and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Merchant Shipping (Fees) (Amendment) Regulations 2003 and shall come into force on 14 April 2003.

Amendment of the Merchant Shipping (Fees) Regulations 1996

2.—(1) The Schedule to the Merchant Shipping (Fees) Regulations 1996(2) shall be amended as follows.

(2) In Part I—

(a)in paragraph 1(2), at the end of section F, there shall be added the following title and number:

(b)at the end of paragraph 1(2), after section M, there shall be added the following:

(e)after paragraph 3(h), there shall be added the following:

(i)any issue or re-issue of a statutory certificate or the issue of a letter of acceptance in lieu of a statutory certificate..

(3) In Part VII, for paragraph 1 there shall be substituted the following:

(4) In Part VIII, for paragraphs 1 to 15 and the final paragraph beginning with the words “Where two or more changes” there shall be substituted the following:

Explanatory Note

(This note is not part of the Regulation)

These Regulations further amend the Merchant Shipping (Fees) Regulations 1996 (S.I. 1996/3243).

The Regulations amend the Schedule to prescribe changes in some of the fees charged and to introduce new fees. In particular—

(1) the hourly rate for fees relating to certain services listed in Parts I and XII has been increased from £74 to £76;

(2) fees have been reintroduced for “out of normal hours” working (Part XII—additional charges) in respect of surveys, inspections and tests other than radio surveys (for which fees are already charged);

(3) revised fees have been introduced in relation to services listed in Part VII (registration etc of ships and submersible craft) and Part VIII (registration of fishing vessels).

The Regulations also amend the statutory references in Part I, in particular adding a new Part N (Safety Management).

The principal changes to the fees charged are shown in the following table:
