The Secretary of State for Health in exercise of the powers conferred on him by sections 7(3) and (4), 8(2) to (4) and 64(6) to (8) of the Health and Social Care Act 2001(1) and by sections 17 and 126(4) of the National Health Service Act 1977(2) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Local Authority (Overview and Scrutiny Committees Health Scrutiny Functions) Amendment Regulations 2004 and shall come into force on 21st June 2004.
(2) These Regulations apply to England only.
(3) In these Regulations “the principal Regulations” means the Local Authority (Overview and Scrutiny Committees Health Scrutiny Functions) Regulations 2002(3).
2.—(1) Regulation 1(3) of the principal Regulations (interpretation) is amended as follows.
(2) In the definition of “local authority”, in both paragraphs (a) and (b) respectively, after “applies”, for “and” there is substituted “,”; and after “London” there is inserted “and the Council of the Isles of Scilly(4)”.

These Regulations amend the Local Authority (Overview and Scrutiny Committees Health Scrutiny Functions) Regulations 2002 in order to extend their application to the Council of the Isles of Scilly.
S.I. 2002/3048.
See S.I. 2004/1412 which applied the relevant powers under section 21 of the Local Government Act 2000 (c. 22) to the Council and S.I. 2004/1425 extending sections 7, 8 and 9 of, and Schedule 1 to, the Health and Social Care Act 2001 (c. 15) to the Council.
