This Order brings into force in Wales on 23rd July 2004 the provisions of section 79 of the New Roads and Street Works Act 1991, except subsection (1)(c). Section 79 of the Act imposes a duty on undertakers to keep records of the location of apparatus in streets in certain circumstances. Subsection (1)(c) imposes the duty when the undertaker is informed of the apparatus' location under section 80 of the Act, which is not yet in force.
