The Maximum Number of Judges (Northern Ireland) Order 2004

Whereas a draft of this Order has been approved by resolution of each House of Parliament:

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 2(3) of the Judicature (Northern Ireland) Act 1978(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the Maximum Number of Judges (Northern Ireland) Order 2004 and shall come into force on the day after that on which it is made.

2.  In section 2(1) of the Judicature (Northern Ireland) Act 1978 (the High Court) for the words “not more than nine puisne judges” there shall be substituted the words “not more than ten puisne judges” and accordingly the Maximum Number of Judges (Northern Ireland) Order 2001(2) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order amends section 2(1) of the Judicature (Northern Ireland) Act 1978 to increase from nine to ten the maximum number of puisne judges in Her Majesty’s High Court of Justice in Northern Ireland.
