The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by sections 123(1)(a), (d) and (e), 130(4), 131(10)(a), 135(1), 136(1) and (3) to (5), 136A(3) and (4)(a), 137(1) and (2)(c), (d) and (h) and 175(1) and (3) of the Social Security Contributions and Benefits Act 1992 M1, sections 5(1)(h), 189(1), (4) and (6) and 191 of the Social Security Administration Act 1992 M2, sections 4(5) and 35(1) of the Jobseekers Act 1995 M3, sections 10(6), 79(1) and 84 of the Social Security Act 1998 M4, paragraphs 4(6), 20(1)(b) and 23(1) of Schedule 7 to the Child Support, Pensions and Social Security Act 2000 M5 and sections 2(3)(b), 15(1)(j) and (6)(b), 16(2)(a) and 17(1) of the State Pension Credit Act 2002 M6 and of all other powers enabling him in that behalf, after consultation with organisations appearing to him to be representative of the authorities concerned M7 and after agreement by the Social Security Advisory Committee that proposals in respect of these Regulations should not be referred to it M8, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Social Security (Housing Benefit, Council Tax Benefit, State Pension Credit and Miscellaneous Amendments) Regulations 2004 and shall come into force—
a
for the purposes of this regulation and regulations F1... 7(1) to (4) and (6), on 4th October 2004;
b
for the purposes of regulation 8, on 6th October 2004;
c
for all other purposes, on 4th April 2005.

Amendment of the Income Support (General) Regulations 19875
In Schedule 3 to the Income Support (General) Regulations 1987 M10 (housing costs)—

detained in custody on remand pending trial or, as a condition of bail, required to reside—

in a dwelling, other than the dwelling he occupies as his home; or

in premises approved under section 9 of the Criminal Justice and Court Services Act 2000,

Amendment of the State Pension Credit Regulations 20027

The State Pension Credit Regulations 2002 M12 shall be amended in accordance with the following provisions of this regulation.

In regulation 1(2) (interpretation), after the definition of “Eileen Trust” insert—
“equity release scheme” means a loan—
a
made between a person (“the lender”) and the claimant;
b
by means of which a sum of money is advanced by the lender to the claimant by way of payments at regular intervals; and
c
which is secured on a dwelling in which the claimant owns an estate or interest and which he occupies as his home;

At the end of regulation 15(5) (income for the purposes of the Act), add—

any payment made at regular intervals under an equity release scheme.

At the end of regulation 16 (retirement pension income), add—

any payment made at regular intervals under an equity release scheme.

Amendment of the Social Security (Claims and Payments) Regulations 19878
In regulation 4F of the Social Security (Claims and Payments) Regulations 1987 M13 (making a claim after attaining the qualifying age: date of claim), in paragraph (3)—

for “claimant”, the first time it appears, substitute “
person wishing to make a claim
”
; and
b
in sub-paragraph (a), after “informs” insert “
