Paragraphs (2), (3) and (6) of regulation 2 also apply to proceedings instituted before 1st October 2004 if before that date an employment tribunal in proceedings before it has not required a member of the panel of independent experts (within the meaning of subsection (4) of section 2A of the Equal Pay Act 19703) to prepare a report under subsection (1)(b) of that section.
