The County of Derbyshire (Electoral Changes) Order 2004

Made

Coming into force in accordance with article 1(2)

Whereas the Local Government Commission for England, acting pursuant to section 15(4) of the Local Government Act 19921, has submitted to the Secretary of State recommendations dated August 2000 on its review of the county of Derbyshire:

And whereas the Electoral Commission2 have decided to give effect, with modifications, to those recommendations:

And whereas a period of not less than six weeks has expired since the receipt of those recommendations:

Now, therefore, the Electoral Commission, in exercise of the powers conferred on them by sections 173 and 264 of the Local Government Act 1992, and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1

This Order may be cited as the County of Derbyshire (Electoral Changes) Order 2004.

This Order shall come into force –

a

for the purpose of proceedings preliminary or relating to any election to be held on the ordinary day of election of councillors in 2005, on the day after that on which it is made;

b

for all other purposes, on the ordinary day of election of councillors in 2005.

Interpretation2

In this Order –

  • “county” means the county of Derbyshire;

  • “existing”, in relation to an electoral division or ward, means the electoral division or ward as it exists on the date this Order is made; and

  • references to wards, unless the context otherwise requires, are references to district and borough wards in the county5.

Electoral divisions of the county of Derbyshire3

The existing electoral divisions of the county6 shall be abolished.

The county shall be divided into sixty-four electoral divisions which shall bear the names set out in column (1) of the Schedule.

Each electoral division shall comprise the area described in column (2) of the Schedule by reference to wards, parishes, or parish wards and the number of councillors to be elected for each electoral division shall be one.

Electoral registers4

The Electoral Registration Officer7 for each district or borough in the county shall make such rearrangement of, or adaptation of, the register of local government electors as may be necessary for the purposes of, and in consequence of, this Order.

Revocation5

The County of Derbyshire (Electoral Arrangements) Order (1980)8 is revoked, save for article 4.

This Order gives effect, with modifications, to recommendations by the Local Government Commission for England for electoral changes in the county of Derbyshire. The recommendations were submitted to the Secretary of State, but the functions of the Secretary of State under sections 13 to 15 and 17 of the Local Government Act 1992 so far as they relate to electoral changes were transferred with modifications to the Electoral Commission under the Local Government Commission for England (Transfer of Functions) Order 2001 (S.I.2001/3962), with effect from 1st April 2002. That Order provides that recommendations submitted to the Secretary of State before 1st April 2002 would have effect as if they had been submitted to the Electoral Commission.

The modifications concern the names of Belper, Bolsover North West, Elmton and Whitwell, Bolsover South West and Scarcliffe, Pinxton and South Normanton West, and South Normanton East and Tibshelf electoral divisions and the boundary between Dronfield South, and Holymoorside and Wingerworth electoral divisions.

The changes have effect in relation to local government elections to be held on and after the ordinary day of election of councillors in 2005.

Article 3 abolishes the existing electoral divisions of the county and provides for the creation of 64 new electoral divisions. That article and the Schedule also make provision for the names and areas of, and numbers of councillors for, the new electoral divisions. The number of councillors for each electoral division shall be one.

Article 4 obliges the Electoral Registration Officer in each district or borough in the county of Derbyshire to make any necessary amendments to the electoral register for that district or borough to reflect the new electoral arrangements.

Article 5 revokes the County of Derbyshire (Electoral Arrangements) Order 1980, with the exception of article 4.
