The Gangmasters (Licensing) Act 2004 (Commencement No. 1) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by section 29(1) of the Gangmasters (Licensing) Act 2004 (1), makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Gangmasters (Licensing) Act 2004 (Commencement No. 1) Order 2004 and shall come into force on 1st December 2004.

(2) In this Order—

“the 2004 Act” means the Gangmasters (Licensing) Act 2004;

“the Authority” means the Gangmasters Licensing Authority.

Provisions coming into force

2.  The following provisions of the 2004 Act are in force—

(a)section 1 (establishing the Authority);

(b)section 2 (directions given to the Authority by the Secretary of State);

(c)section 3 (work to which the 2004 Act applies);

(d)section 4 (defining what is meant by “acting as a gangmaster”);

(e)section 5 (defining the territorial scope of application of the 2004 Act);

(f)section 6(2) (power to make regulations specifying when a licence is not required);

(g)section 10 (power to make regulations establishing an appeals process);

(h)section 25 (general provisions regarding regulations, rules and orders);

(i)section 26 (meaning of “worker”);

(j)section 28 (application of the 2004 Act to Northern Ireland) in so far as it relates to paragraphs 1 to 8, 11, 19 and 21 of Schedule 2;

(k)section 30 (short title and extent);

(l)Schedule 1 (consequential amendments); and

(m)paragraphs 1 to 8, 11, 19 and 21 of Schedule 2.

Explanatory Note

This Order brings into force the provisions of the Gangmasters (Licensing) Act 2004 specified in article 2 of the Order.
