The Secretary of State, in exercise of the powers conferred upon him by sections 47(1) and (3) of the Disability Discrimination Act 1995(1), having consulted the Disabled Persons Transport Advisory Committee and such other persons as he considered appropriate in accordance with section 47(3) of that Act, hereby makes the following Order:
1. This Order may be cited as the Rail Vehicle Accessibility (South West Trains Class 444 and Class 450 Vehicles) Exemption (Amendment) Order 2004 and shall come into force on 31st December 2004.
2.—(1) The Rail Vehicle Accessibility (South West Trains Class 444 and Class 450 Vehicles) Exemption Order 2003(2) is amended as follows.
(2) In article 5–
(a)after the words “the rail vehicles numbered 68101 to 68200”, there shall be added “and 66851 to 66860”; and
(b)for the words “numbered 450001 to 450100”, there shall be substituted “numbered 450001 to 450110”.

This Order amends the Rail Vehicle Accessibility (South West Trains Class 444 and Class 450 Vehicles) Exemption Order 2003 (S.I. 2003/1704) which authorises the use of specified rail vehicles even though they do not conform with the Rail Vehicle Accessibility Regulations 1998 (S.I. 1998/2456, amended by S.I. 2000/3215). This Order authorises the use of additional specified vehicles in the Class 450 fleet of electric multiple units because more force than is permitted is required to operate the folding nappy-changing table, which is situated in the wheelchair accessible toilet cubicle.
