The Secretary of State for Health, in exercise of the powers conferred on him by section 201 of the Health and Social Care (Community Health and Standards) Act 2003(1) and of all other powers enabling him in that behalf, hereby makes the following Order:—
(1)
2003 c. 43 (“the Act”); the powers are exercisable by the appropriate authority, who is defined in section 199(2) of the Act in relation to Part 1 of the Act which makes provision for NHS foundation trusts, as the Secretary of State.
