Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) (Amendment No. 2) Order 2004

The Secretary of State, in exercise of the powers conferred upon her by section 411(2) of the Communications Act 2003(1) hereby makes the following Order:

Citation

1.  This Order may be cited as the Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) (Amendment No. 2) Order 2004.

Amendment of the principal Order

2.—(1) The Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) Order 2003(2) shall be amended as follows.

(2) In article 4, after paragraph (1) insert—

(1A) Section 367 of the principal Act shall come into force on 9th March 2004 for the purposes of enabling regulations to be made under section 6(1) of the Wireless Telegraphy Act 1967 as amended by that section.

(3) In Schedule 2, for the entry relating to sections 363 to 368 substitute the following entry—

Explanatory Note

(This note is not part of the Order)

This Order amends the Office of Communications Act 2002 (Commencement No. 3) and Communications Act 2003 (Commencement No. 2) 2003.

The Order provides for section 367 of the Communications Act 2003 to come into force on 9th March 2004 for the purposes of enabling regulations to be made under section 6(1) of the Wireless Telegraphy Act 1967 as amended by that section. Section 367 is to come into force on 1st April 2004 for all other purposes.
