The Crime (International Co-operation) Act 2003 (Commencement No. 1) Order 2004

Whereas the day appointed for the coming into force of the provisions of Part 1 of the Crime (International Co-operation) Act 2003(1) which are listed in articles 2 and 3 of this Order is one decided on by the Secretary of State and the Scottish Ministers;

Now, therefore, in exercise of the powers conferred on him by section 94 of that Act, the Secretary of State hereby makes the following Order:

1.—(1) The Order may be cited as the Crime (International Co-operation) Act 2003 (Commencement No. 1) Order 2004.

(2) In this Order “the Act” means the Crime (International Co-operation) Act 2003.

2.  Sections 49 to 51 of the Act shall come into force on 26th March 2004.

3.—(1) The following provisions of the Act shall come into force on 26th April 2004.

(2) Those provisions are—

  • sections 1 to 9;

  • sections 13 to 19, together with Schedule 1;

  • sections 26 to 31, together with Schedule 2;

  • sections 47 and 48;

  • sections 52 and 53;

  • sections 80 to 85;

  • section 88;

  • section 91;

  • paragraphs 1 to 4, 7 to 16, 38 to 44, 61 to 71, 75 to 83 of Schedule 5; and

  • the entries in Schedule 6 which are listed in paragraph (3).

(3) The entries in Schedule 6 (repeals) are those relating to—

  • the Criminal Justice Act 1987(2);

  • the Criminal Justice (International Co-operation) Act 1990(3);

  • the Criminal Justice and Public Order Act 1994(4);

  • the Criminal Law (Consolidation) (Scotland) Act 1995(5);

  • the Criminal Justice and Police Act 2001(6); and

  • the Proceeds of Crime Act 2002(7).
