CIVIL CONTINGENCIES

The Civil Contingencies Act 2004 (Amendment of List of Responders) Order 2005

Coming into force

Whereas a draft of this Order has been laid before and approved by resolution of each House of Parliament in accordance with section 17(2) of the Civil Contingencies Act 20041 (“the Act”);

Now therefore, the Minister for the Cabinet Office, in exercise of the powers conferred by section 13(1)(a) of the Act, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Civil Contingencies Act 2004 (Amendment of List of Responders) Order 2005 and comes into force on 14th November 2005.

Amendment of Schedule 1 to the Civil Contingencies Act 20042

In Schedule 1 to the Civil Contingencies Act 2004 –

a

in Part 1 (Category 1 responders: general), for paragraph 9(1) (the Health Protection Agency), substitute –

  • The Health Protection Agency established by section 1 of the Health Protection Agency Act 20042 in so far as its functions relate to Great Britain

in Part 3 (Category 2 responders: general), after paragraph 29 insert –

Health29A

A Strategic Health Authority established under section 8 of the National Health Service Act 19773.

This Order amends Schedule 1 to the Civil Contingencies Act 2004 (which lists Category 1 and Category 2 responders for the purposes of Part 1 of that Act). The Order provides that the Health Protection Agency is a Category 1 responder only in so far as its functions relate to Great Britain. It also amends Schedule 1 so as to provide that Strategic Health Authorities are Category 2 responders.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
